JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 1.9.2014 in a case registered for the offences punishable under Section 498A of the Indian Penal Code. The accusation is of torture for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner was initially granted bail vide order dated 22.5.2014 passed by the learned Magistrate on the basis of compromise between the parties but subsequently the informant filed a petition for cancellation of bail since the petitioner was violating the terms of compromise and ultimately the bail was cancelled by the learned Magistrate vide order dated 17.7.2014. It appears from the impugned order that the learned

Patna High Court Cr.Misc. No.51773 of 2014 (2) dt.05-01-2015 2/2 Magistrate tried to reconcile the issued afresh after getting the petitioner produced from custody but the petitioner refused to reconcile the issue.

Considering the nature of accusation and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patnacity, Patna in connection with Agam Kuan P.S. Case No. 113 of 2014.
