This application, for grant of regular bail, arises out of Bodh Gaya (Cherki) Police Station Case No. 608 of 2022, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018. It is alleged that 80 litres of mahua liquor has been recovered from the tempo of the petitioner. The petitioner is in custody since 10.03.2023 and he has two criminal antecedent. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case.

Considering the fact and circumstances of the case, let the petitioner, named above, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (ten thousand)

Patna High Court CR. MISC. No.34172 of 2023(2) dt.23-05-2023 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Exclusive Special Excise Court No.-1, Gaya, in connection with Bodh Gaya (Cherki) Police Station Case No. 608 of 2022. The petitioner shall mark his presence in Bodh Gaya (Cherki) Police Station, Gaya, on 1st Sunday of every month, failing which, the bail bonds of the petitioner would be cancelled.
