JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-02-2016 Heard learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. Earlier prayer for bail of petitioner was rejected by this Court taking note of this fact that looted motorcycle has been recovered from the house of petitioner but submission on behalf of petitioner is that name of petitioner came in this case in confessional statement of co-accused Rampravesh Rai @ Pravesh Rai and on the basis of aforesaid confessional statement of coaccused Rmpravesh Rai @ Pravesh Rai, looted motorcycle is said to have been recovered from the house of petitioner and thereafter the confessional statement of petitioner was recorded and another looted motorcycle was recovered from the house of co-accused Pankaj Kumar. Further contention on behalf of petitioner is that
Patna High Court Cr.Misc. No.4626 of 2016 (2) dt.24-02-2016 2/2 petitioner is in jail custody for about 11 months, but up till now the trial has not been concluded and moreover Rampravesh Rai @ Pravesh Rai has already been granted privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 24749 of 2015 on 19.08.2015.
Considering the aforesaid facts and circumstances as well as submissions of the parties and detention of petitioner in judicial custody, let petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S. Case No. 16 of 2015.
