The petitioner seeks bail in a case registered under Sections 364, 302, 201/34 of the Indian Penal Code. Allegation is that the accused persons kidnapped the father of the informant and killed him and thrown the dead body in the river.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. As per F.I.R., mere a suspicion has been raised against the petitioner and other co-accused. Except for
Patna High Court CR. MISC. No.31236 of 2019(2) dt.10-05-2019 2/2 suspicion, there is no other substantive evidence to suggest his implication in the present case. There is no eye witness to the alleged occurrence. There is land dispute pending between the parties.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil (Singhol) P.S. case No.653 of 2018.
