JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-05-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Dehri Town (Dalmianagar) P.S. Case No. 927 of 2020, registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 34 of the Indian Penal Code.

As per allegation in fardbeyan, co-accused Vicky @ Bamvilar, Sanjeet Yadav and the present petitioner were assaulting one Abhinav Pratap. When the informant intervened, co-accused Vicky assaulted him with rod on his head and co-accused Sanjeet Yadav also assaulted him with iron rod on his head. Similarly, coaccused Sadhu Yadav also assaulted him with rod. The accused

Learned counsel for the petitioner has submitted that there is contradiction in the statement of the informant. He has also submitted that injuries sustained by the informant are simple in nature.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Rohtas at Sasaram in connection with Dehri Town (Dalmianagar) P.S. Case No. 927 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
