JUSTICE SANDEEP KUMAR ORAL ORDER 27-06-2024 Re:- Interlocutory Application No.01 of 2024 This interlocutory application has been filed by Dewa Gupta, who is accused in a case, for impleading him as intervenor respondent in the present case.

As the investigation has been concluded by the Police and appropriate action is being taken against the accused persons including the intervenor, this Interlocutory Application is rejected.

Heard the parties.

By way of this writ petition, the petitioner has prayed for the following relief:-

Patna High Court CR. WJC No.970 of 2024(3) dt.27-06-2024 2/2 "(i) To conduct the investigation of Chakia P.S. Case No. 301 of 2023 in a fair, impartial and transparent manner.

(ii) To ensure the security of life of the witnesses of Chakia P.S. Case No. 301 of 2023."

A counter affidavit has been filed by respondent no.3 (Superintendent of Police, East Champaran at Motihari), which is taken on record.

The Superintendent of Police, East Champaran at Motihari has assisted this Court virtually. He has submitted that in this case charge-sheet has been filed against accused persons and the S.I.T. has also been constituted. The petitioner has got the police protection also. 7.

In these circumstances, nothing survives in this case.

Accordingly, this criminal writ petition stands disposed of. It is expected that absconding accused persons are arrested at the earliest.
