JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, when CDR of the mobile was taken out, it was detected that the mobile number, given in the first information report, belonged to the petitioner. Submission on behalf of petitioner is that the petitioner had applied for loan but the informant, being Bank Manager, demanded illegal money, which was denied by the petitioner and that is why, the informant lodged this false case, when the petitioner told him that he was going to lodge a case in vigilance against him. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody since 21-10-2015.

Patna High Court Cr.Misc. No.3359 of 2016 (2) dt.03-02-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chakia P.S. Case No. 209 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran.
