The petitioner has preferred this application for grant of regular bail in a case registered under section 30(d) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted various utensils for manufacturing of liquor and 3000 litres of mahua jaggery solution was found. The local people and the choukidar disclosed that the same belonged to the five named accused persons including the petitioner herein. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedents. The petitioner is in custody since 3.3.2021

Patna High Court CR. MISC. No.44169 of 2021(2) dt.24-01-2022 2/2 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Sirdala P.S. Case no. 510 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
