02-11-2021 Heard learned counsel for the parties.
The petitioner seeks bail in Lodipur P.S. Case No. 11 of 2021, registered for the offence under Sections 385, 387 / 34 of the Indian Penal Code.
As per the prosecution case, on 14.01.2021 (night), on a secret information that some miscreants are collecting illegal rangdari from the vehicle owners/drivers, a raid was conducted and one co-accused Kundan Kumar Yadav was apprehended on the spot, who disclosed the name of petitioner and other coaccused persons, who fled away from there. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and he has been made accused merely on suspicion and on the confession of apprehended co-accused Kundan Kumar Yadav. No incriminating article has been recovered from the possession of
Patna High Court CR. MISC. No.44050 of 2021(3) dt.02-11-2021 2/2 the petitioner and he is in custody since 05.02.2021. Chargesheet has been submitted.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Bhagalpur in connection with Lodipur P.S.
