02. In the present case, the petitioner seeks bail in connection with Special (POCSO Act) Case No. 200 of 2022 arising out of Bihta P.S. Case No. 178 of 2022 registered for the alleged offences under Sections 448, 354(B), 506 of the Indian Penal Code and Sections 8/12 of POCSO Act.

03. As per prosecution case, the petitioner, sexually assaulted the minor daughter of the informant in inebriated condition and made attempt to rape her.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken

There is delay of 4 days in submitting the written report to the police and the FIR has been sent to the learned Judicial Magistrate after 10 days and these facts show deliberation and after thought. Learned counsel further submits that the fact of the case is that the petitioner's cousin is married with the son of the informant and they have been torturing her and in order to pressurize the petitioner not to file any complaint against the informant and others, this false case has been lodged. Learned counsel further submits that the victim girl refused to undergo medical examination and during investigation she said that she was not raped and for this reason, she did not want to undergo the medical examination. Learned counsel further submits that the petitioner is having clean antecedent and he is in custody since 21.02.2026. Charge sheet has been submitted.

05. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the victim girl in her statement recorded under Section 164 CrPC described in detail the gruesome act of the petitioner. The petitioner is the maternal cousin of the sister-in-law of the victim and taking advantage of the fact that the victim was alone in her house, the petitioner started TV, put it on high volume and made attempt to rape the victim after taking off her clothes.

06. Having regard to the nature of allegation, I am not inclined to enlarge the petitioner on bail and hence, his prayer for bail is rejected.

07. The learned trial court is directed to expedite the trial and conclude the same at the earliest.
