The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 323, 341, 379, 354, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the petitioner is said to have fired thrice on the informant but some how the informant escaped.

It is submitted by learned senior counsel appearing for the petitioner that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. There is case and counter case between the parties. The petitioner is in custody since 2.4.2022 and

Patna High Court CR. MISC. No.35723 of 2022(3) dt.17-01-2023 2/2 chargesheet has been submitted in the case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, no person having been injured in the occurrence, there being case and counter case between the parties, the petitioner being in custody for 9 months since 2.4.2022 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Natwar P.S. Case no. 34 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bikramganj, Rohtas.
