The petitioner is not named in the first information report and it is alleged that first information report named accused, Mukesh Rai, along with other unknown persons, demanded extortion money from the informant and when his demand was not fulfilled, the aforesaid co-accused Mukesh Rai opened fire causing injury to the informant.
Contention on behalf of the petitioner is that petitioner happens to be younger brother of co-accused, Mukesh Rai, and, as a matter of fact, when police raided the house of the petitioner to nab co-accused Mukesh Rai, the police could not succeed to find
Patna High Court Cr.Misc. No.4745 of 2016 (2) dt.11-02-2016 2/2 the co-accused, Mukesh Rai, but arrested the petitioner, who was present at his home. It is further submitted by him that the petitioner does not have any criminal antecedent and, moreover, he has not been put on test identification parade as yet. Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Darawada P.S. case No. 306/2015.
