Petitioners apprehend their arrest in Taraiya P.S. Case No.19 of 2019 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The informant alleged that petitioner no.1 Ranjeet Singh lodged Taraiya P.S. Case No.114 of 2018 under Sections 341, 323, 504, 506 of the IPC and under Section 25(1-b)a, 26 and 35 of the Arms Act and presented a country made pistol with five live cartridges alleged to have been recovered from possession of Bhrigun Singh (own brother of petitioners) in which petitioner nos.2 and 3, namely, Maithili Sharan Singh and Bipin Singh were witnesses. It is further alleged that after investigation, the case lodged by petitioner no.1 against Bhrigun

Patna High Court CR. MISC. No.31934 of 2019(2) dt.14-05-2019 2/2 Singh was found false.

Learned counsel for the petitioners submits that the police without appreciating the truthfulness of the case of petitioner no.1 found the case of petitioner no.1 false and lodged the present case.

Having considered the facts that Bhrigun Singh is a police personnel and he earlier filed a case against the petitioners, who are own brothers of Bhrigun Singh and petitioner no.1 also filed a case against Bhrigun Singh which was found false after investigation and the Investigating Officer lodged the present case for falsely implicating Bhrigun Singh, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Saran in connection with Taraiya P.S. Case No.19 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
