The petitioner is in custody in connection with Patrakar Nagar P.S. Case No. 27 of 2020, for the offence under Section 414/34 of the Indian Penal Code and Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case, two persons including the petitioner were apprehended by the police and from their custody, 20 pouch of brown sugar, three mobiles, broken motorcycle lock, purse containing some documents and Rs.1600/- were recovered. Learned counsel further submits that other co-accused, namely, Abhay Kumar has been granted bail

Patna High Court CR. MISC. No.36260 of 2020(2) dt.29-01-2021 2/2 by a coordinate Bench of this Court vide order dated 06.01.2021 passed in Cr. Misc. No.30308 of 2020. Petitioner is in custody since 09.01.2020.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 09.01.2020, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner has to deposit Rs.1,00,000/- in cash. On depositing the amount of Rs.1,00,000/-, petitioner, abovenamed, shall be released on bail on furnishing bail bond of Rs. 1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Patrakar Nagar P.S. Case No.27 of 2020.

Deposit of Rs.1,00,000/- (Rupees one lakh) shall abide by final outcome of Patrakar Nagar P.S. Case No.27 of 2020.
