The petitioner is languishing in custody since 28.06.2014 in a case registered for the offences punishable under Sections 341, 323, 212, 353, 307, 120B of the Indian Penal Code, 25(1-B)a/26/27/35 of the Arms Act and 17 of Criminal Law Amendment Act.
From the possession of the petitioner one loaded country made pistol, three live cartridges, Naxal dress and Naxal C.D. were recovered.
Considering the nature of recovery and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with
Patna High Court Cr.Misc. No.10726 of 2015 (02) dt.24-03-2015 2/2 two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S. Case No. 56 of 2014.
Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
