JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This application, for grant of anticipatory bail, arises out of Garkha P.S. Case No. 496/2018, disclosing offences under Sections 341, 323, 324, 307, 348 and 504 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons intercepted the motorcycle of the informant and demanded Rs. 5,000/- from him and one co-accused Rajesh Mahto assaulted the informant by the butt of the country made pistol and while the brother of informant Randhi Singh came to save him, Harendra Mahto assaulted him with knife causing cut injury in his right hand.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and no specific allegation has been attributed to the petitioner and the allegation of assault to

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XIV, Saran at Chapra, in connection with Garkha P.S. Case No. 496/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
