JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case was lodged against unknown persons but in course of investigation, when one Ashok Singh was arrested in connection with another case, the mystery of this case started unfolding when the aforesaid Ashok Singh confessed his guilt, disclosing the name of his associates, including one Ajay Singh who was, later on, apprehended and made his confessional statement, disclosing the name of the petitioner. Learned counsel for the petitioner submits that except the so-called confessional statements, there is nothing against the petitioner and moreover, even if, aforesaid confessional statement assumed to be true, then also, there is only allegation of
Patna High Court Cr.Misc. No.2720 of 2016 (3) dt.18-02-2016 2/2 conspiracy against the petitioner.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that investigation against the petitioner has already been completed, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sitamarhi P.S. Case No. 790 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
