2. In the present case, the petitioner seeks bail in connection with Araria (R.S) P.S. Case No. 934 of 2022, registered for the alleged offence under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
3. As per prosecution case, the petitioner and other coaccused persons, in the background of land dispute, assaulted the son of the informant and his family members.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is specific allegation against the petitioner in the FIR that he assaulted the son of the informant on his head by sword, but the injury report falsifies the allegation as no injury
Patna High Court CR. MISC. No.32404 of 2025(3) dt.01-09-2025 2/3 of any sharp cut weapon has been found on the head of the son of the informant. The injury on the son of the informant is stated to be caused by hard and blunt substance, though the injury is stated to be grievous in nature. The learned counsel further submits that the petitioner is in custody since 02.04.2024 and is having clean antecedent. The charge sheet has been submitted.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made hereinabove and considering the absence of any injury attributed to this petitioner and further considering the submission of charge sheet, the period of custody of the petitioner and his clean antecedent, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/court concerned, in connection with Araria (R.S.) P.S. Case No. 934 of 2022, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
