JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 09.10.2014 in connection with Koilwar P.S. Case No. 157 of 2014 on the accusation that he made attempt to withdraw Rs. 52,000/- from the account of other person.
The contention on behalf of the petitioner is that one person having nomenclature of the petitioner is also residing in his village and as a matter of fact the cheque was issued to the aforesaid person but under some misconception the petitioner received the cheque and went to withdraw the amount as the petitioner had also an account in the same branch. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.50512 of 2014 (4) dt.31-03-2015 2 / 2 bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case No. 157 of 2014.
