JUSTICE MADHURESH PRASAD ORAL ORDER 13-01-2021 The claim made in the writ petition is for a direction to the respondents to dispose of the representation dated 14.09.2016 filed by the petitioner claiming dues under the head pension, salary arrears and D.A. etc.

Learned counsel for the petitioner is not present in Court. Learned counsel for the Patna Municipal Corporation is also not present.

The ordersheet reveals that earlier time has been granted twice to the respondent-Corporation for filing a counter

Patna High Court CWJC No.4792 of 2017(5) dt.13-01-2021 2/2 affidavit. However, no such counter affidavit has been filed till date.

Since the claim in the writ petition is for a direction to dispose of the representation of the petitioner dated 14.09.2016 and no adjudication is called for in the instant proceedings, this Court would dispose of the writ petition with direction to the Municipal Commissioner, Patna Municipal Corporation, Patna (Respondent No.3) to consider the representation of the petitioner dated 14.09.2016 (Annexure 1) and pass a reasoned and speaking order thereupon. The dues, if found admissible, should also be paid to the petitioner. The entire exercise would be required to be completed by the Respondent No.3 within six weeks from the date of receipt/submission of a copy of this order.

The writ application stands disposed of.
