JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2025 This case has been listed under the heading 'For Orders on Office Notes' with notings that case diary and post mortem report, called for by this Court vide order dated 20.5.2025, have not been received in this case. However, learned counsel for the petitioners submits that another bail petition arising out of same police case, namely, Cr.Mis.No. 50379/2025 is also on the Board today at serial no. 21 in which case diary and post mortem report have already been received and kept on record. As such, present case is heard side by side with Cr.Mis.No. 50379/2025.

2. Heard learned counsel for the parties and perused the case diary.

3. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 103(1) and 238 of the Bharatiya Nyaya Sanhita, 2023.

4. As per prosecution case, due to dispute with regard to pathway, all the FIR named accused persons including these petitioners killed mother of the informant by strangulation. Thereafter, they disfigured face of the deceased.

5. Learned counsel appearing for the petitioners submits that these petitioners are innocent and have falsely been implicated in this case. Informant is not eye witness of the occurrence and only on account of previous dispute, petitioners have been made accused in this case on the basis of suspicion. F.I.R. has been lodged after inordinate delay of 19 days without any explanation which renders the entire prosecution case doubtful. Learned counsel submits that save and except suspicion, there is no other direct or indirect evidence against these petitioners to show their complicity in the occurrence. Petitioners claims clean antecedent.

6. Learned counsel for the State and the informant oppose the prayer for bail.

7. Considering the facts of the case, in the event of arrest or surrender within eight weeks from today, let both these

No.32461 of 2025(3) dt.07-11-2025 3/3 petitioners, named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Lakhisarai in Halsi Police Station Case No. 299 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
