JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the victim is languishing in jail since 03.12.2015 in a case registered for the offences punishable under Sections 498A and 304B of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after three years of the marriage.

It is submitted by learned counsel for the petitioner that since the son of the petitioner performed love marriage with the daughter of the informant which is admitted by the informant in the FIR, there is no question of demand of dowry. Moreover, the victim and her husband used to reside at village home whereas the petitioner was residing at Narkatiyaganj. The petitioner claims to be separate from the husband of the victim.

Patna High Court Cr.Misc. No.3810 of 2016 (2) dt.25-01-2016 2/2 Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 160 of 2015.
