Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 337, 338, 354, 379, 504 and 506/34 of the Indian Penal Code, registered in connection with Magadh Giriak P.S.Case No.86 of 2021. As per allegation, the petitioners along with coaccused Rajesh Kumar and Nitesh Kumar assaulted the informant with Khanti. There is also allegation against the petitioners that they outraged the modesty of the wife of the informant.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.44068 of 2021(2) dt.11-04-2022 2/2 that they are innocent and they are persons of clean antecedents. The injury sustained by the informant has been mentioned as simple in nature in the order of the learned Sessions Judge, Nalanda.

Considering the above facts and circumstances, specially the clean antecedents of the petitioners, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM-1, Nalanda at Biharsharif in connection with Giriak P.S. Case No. 86 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
