2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 409,420/34 of the Indian Penal Code.

3. As per the prosecution case, this petitioner along with other accused persons misappropriated huge money of different schemes of Nal Jal Yojana.

4. Learned counsel appearing for the petitioner submits that work upto Rs.11.18 lacs have been done and work upto Rs.1.50 lacs is remained to be completed. He submits that the petitioner was merely Ward Sachiv and his duty was only to monitor the work and hence petitioner has no power of expenses and withdrawal of money for execution of the work in the ward. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation that he and co-accused Kilabuddin Hawari had been given Rs.12.69 lacs for completing work under the Nal Jal Scheme but they did not complete the work.

6. Considering the nature of accusation, prayer for bail of the petitioner is rejected.
