2. The petitioner seeks bail in a case registered for the offence punishable under Sections 96 and 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the allegation against the petitioner is that he kidnapped the minor daughter of the informant. It is further alleged that the informant's daughter also took away Rs.72,000/-, and other ornaments along with her.

4. Learned counsel for the petitioner submits that the statement of the victim was recorded after her recovery under Section 183 of the B.N.S.S. (Annexure-P/2) and the same clearly discloses that the petitioner was actually a neighbour of the victim and was also her brother-in-law in

The victim has also admitted that they were having telephonic conversations and she had by her own volition gone along with petitioner to Punjab and stayed there for 3 to 4 days. It is further submitted that even upon medical examination no injury or any signs of sexual contact was found on her body. Petitioner is in custody since 18.12.2025 with clean antecedent and charge-sheet has been submitted.

5. Learned APP for the State opposed the grant of bail on the ground of allegations made in the First Information Report.

Taking into consideration the facts and circumstances and especially considering the statement of the victim under Section 183 of the B.N.S.S. as also her medical examination report, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Araria/concerned Court below in connection with Raniganj P.S. Case No. 240 of 2025. (Soni Shrivastava, J) anand/prachi/- U T
