JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.01.2015 in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

The theft of motorcycle of the informant was committed on 02.01.2015 but he lodged the case on 13.01.2015. The contention on behalf of the petitioner is that as a matter of fact, there was some dispute between the petitioner and informant regarding payment of money and informant himself handed over his motorcycle to petitioner to settle the dispute of above stated payment.

No doubt, the stolen motorcycle is said to have been recovered from the house of the petitioner but petitioner does not

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 16 of 2015.
