JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-12-2020 Heard Mr. Amit Kumar Rakesh, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Hajipur Town P.S. Case No. 25 of 2020 registered for the offence under Section 306/34 of the I.P.C.

The allegation as per the First Information Report is that the sister of the informant was married to the petitioner about 09 years back and out of wedlock 02 children had taken birth. It has further been alleged that petitioner used to torture the sister of the informant along with other accused persons due to which his sister committed suicide.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case inasmuch as about 09 years back the petitioner had performed love marriage with the deceased and they were living happily and out of the wedlock 02 children were born. However due to unemployment

No.32707 of 2020(2) dt.07-12-2020 2/2 of the petitioner he was not able to fulfill the needs of the family which caused annoyance to the deceased i.e. the wife of the petitioner and she committed suicide. Learned counsel next submits that petitioner is in custody since 10.01.2020. After having learned counsel for the parties and taking into consideration the materials available on record and the fact that petitioner is in custody since 10.01.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur at Vaishali / court concerned in connection with Hajipur Town P.S. Case No. 25 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
