JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 30.10.2013 in a case registered for the offences punishable under Sections 147, 148, 149, 302, 201 of the I.P.C and Section 27 of the Arms Act.

It is alleged against the petitioner that petitioner and Uday Yadav made indiscriminate firing on Suday Yadav, nephew of the informant, as a result he died. It is submitted by learned counsel for the petitioner that accusation of firing is against several accused persons and the victim was in the river when the firing was resorted to. Hence it can not be said that whose firing hit the victim.

Considering the fact that application for bail of similarly situated co-accused Uday Yadav has been rejected by this Court, this Court is not inclined to grant bail to the

Patna High Court Cr.Misc. No.10683 of 2015 (2) dt.23-03-2015 2/2 petitioner.

Accordingly the application is dismissed in connection with Sessions Trial No. 444 of 2014, arising out of Pandarak P.S. Case No. 82 of 2013.
