The petitioner seeks bail in Kanti P.S. Case No. 221 of 2014 registered under Section 392 of the I.P.C. Subsequently, Section 411 of the I.P.C. was added.

The petitioner is not named in the F.I.R. but the looted motorcycle was recovered from the courtyard of the petitioner for which Ahiyapur P.S. Case No. 339 of 2014 was registered. The motorcycle was released in favour of the informant. It appears that the petitioner has got criminal antecedent.

It is submitted that the leg of the petitioner was fractured and motorcycle was not recovered from conscious possession of the petitioner.

No.9062 of 2015 (3) dt.22-05-2015 2 / 2 Considering the fact that looted motorcycle was recovered from the house of the petitioner and the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer for bail of the petitioner is rejected in Kanti P.S.Case No. 221 of 2014, pending in the court of the learned S.D.J.M., (West), Muzaffarpur.
