The petitioner is languishing in custody since 22.01.2015 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
Four miscreants entered into the house of the informant and robbed ornaments, cash and mobile set. The FIR was registered against unknown. Name of the petitioner transpired during investigation and the petitioner has been identified by the informant during TIP.
It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner and the identification has been made only by informant.
Patna High Court Cr.Misc. No.13896 of 2015 (03) dt.04-05-2015 2/2 A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and the investigation has already concluded.
Considering the fact that the case is of single identification and the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, District - Patna in connection with Danapur P.S. Case No. 50 of 2015.
