The petitioner is languishing in custody since 06.03.2019 in a case registered for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act. It is alleged that from the possession of the petitioner, one country made pistol along with two live cartridges and a motorcycle were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case and the seized motorcycle belongs to the petitioner. It is further submitted that apart from the present case, the petitioner is accused in two other cases.

Learned APP for the State submits that the said

Patna High Court CR. MISC. No.34646 of 2019(2) dt.28-05-2019 2/2 recovery has been made from the possession of the petitioner and he is involved in two other cases apart from the present case.

Considering the nature of recovery and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Saran at Chapra in connection with Sonepur P.S. Case No.142 of 2019.

However, the learned Court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
