JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302/34 of Indian Penal Code.
As per prosecution case, this petitioner along with other accused persons committed murder of his aunt, Lalmuni Devi, for the sake of property.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and motive alleged for committing the offence is falsified from the fact alone that petitioner is not a relative of the
Patna High Court CR. MISC. No.34345 of 2022(3) dt.09-11-2022 2/2 deceased and in no way he is concerned with the alleged property nor was he going to be benefited from the death of the deceased. It is submitted that informant is not an eye witness of the case and post-mortem report also does not corroborate the prosecution story. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Bairgania P. S. Case No. 142 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
