JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was head master of the concerned school at the relevant time and Rs, 17,26,250/- was sanctioned for construction and Para -43 of the case diary reveals that Rs. 14,34,471/- was deposited in the concerned account and still Rs, 2,44,145/- is lying in the said account and according to prosecution case itself, the petitioner did work to the tune of Rs. 9,05,317.

No doubt, earlier prayer for bail of the petitioner was rejected by this Court vide order dated 26.09.2014 passed in Cr. Misc. No. 37125 of 2014 but admittedly, at the time of passing the

Patna High Court Cr.Misc. No.4595 of 2015 (3) dt.11-03-2015 2/2 above stated order the case diary was not available before this Court.

Considering the aforesaid facts as well as submissions of the parties, above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10.000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Naya Ram Nagar P.S.Case No. 74 of 2014.
