JUSTICE AKHILESH CHANDRA ORAL ORDER 28-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is second attempt made on behalf of the petitioner for the grant of regular bail whose prayer was earlier rejected vide order dated 26.05.2014 passed in Cr. Misc. No. 10044/2014 in connection with S.T. No. 584/2014, arising out of Akbar Nagar P.S. Case No. 70/2013 pending before learned Adhoc A.D.J. - 1st, Bhagalpur.

Perused the report of the trial court indicating six witnesses have already been examined, and as submitted, in the charge-sheet there are only eleven witnesses meaning thereby only five are left with. Trial court expects its conclusion of the trial within nine months which appears exaggerated.

Patna High Court Cr.Misc. No.51040 of 2014 (3) dt.28-01-2015 Taking into consideration the number of witnesses are left with, however, prayer for regular bail of the petitioner is refused.
