This application for anticipatory bail arises out of Gurua P.S. Case No. 238 of 2018, disclosing offences under Sections 341, 323, 324, 337, 354A, 427, 307, 379, 504 and 506/34 of the Indian Penal Code.

It is evident from the FIR that there is a land dispute between the two families. On the alleged date of occurrence, the dispute arose because the persons named in the FIR were

The accused persons are said to have assaulted the informant and her co-sister (gotni). There is allegation of snatching a golden chain against co-accused Balchand Yadav.

It has been submitted on behalf of the petitioners that a counter case has also been registered for the same occurrence. Be that as it may, keeping in mind the background in which the occurrence is said to have taken place, a case for grant of anticipatory bail is made out.

This application is accordingly allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned SDJM, Sherghati in connection with Gurua P.S. Case No. 238 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions,
