JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-05-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Petitioner carries an allegation to have inflicted Dabia, (a sharp cut weapon) blow over informant Jai Kishore Rai causing injury over his head. However, from the order impugned, it is apparent that informant had sustained three injuries out of which two injuries were over head caused by hard and blunt substance, though grievous in nature. With regard to assault by Lathi, Rajendra has been alleged.

In the aforesaid facts and circumstances of the case, petitioner, Saheb Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheohar in Piprahi PS Case No. 41 of 2014.
