Petitioner happens to be husband of the informant and marriage of the informant had taken place with the petitioner 35 years ago.

Moreover, according to the prosecution case itself, informant did not sustain any injury in the alleged occurrence. Petitioner is in jail custody since 8.9.2015. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Hisua P.S. Case no. 177/2015.
