The petitioner seeks bail in Muzaffarpur Sadar P.S. Case No.213 of 2020, registered under Sections 302 and 34 of the Indian Penal Code.

The mother of the deceased alleged that she married her daughter in the year 2010 with Makardhwaj Kumar @ Chulbul, the son of the petitioner. Her daughter also gave birth to a child but thereafter her husband and mother-in-law began to torture her. On the date of occurrence, her daughter telephoned her and disclosed that her husband was assaulting her from the morning. At about 08.00 P.M., the landlord informed that her daughter was killed.

Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased. The deceased was married with the son of the petitioner in the year 2010 and she was residing in village Sherpur, Muzaffarpur. The petitioner was living separately. His father was always demanding money from his maternal grandmother and torturing his mother, the deceased. It is further submitted that the petitioner is in custody since 23.04.2020. The learned Additional P.P. however, opposed the prayer for bail.

Perused the FIR and the case diary. The informant alleged that the petitioner was assaulting his wife and her daughter informed her about the occurrence in the morning, but in the evening the landlord informed her about the death of her daughter. The post mortem report shows that one injury was found on the neck of the deceased. The son of the deceased also disclosed that it was the husband of the deceased who killed his wife, the deceased. The petitioner is the mother-in-law. Taking into consideration the facts aforesaid, petitioner, namely, Meera Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No.213 of 2020.
