2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 395, 397 of the Indian Penal Code and section 27 of the Arms Act and Section 3⁄4 of Explosive Substance Act.
3. As per allegation in the FIR, while the informant was sleeping into his house with family members, at 12 o'clock, 5-6 accused persons entered into his house and hit the informant with stick on his head and took ornaments and four thousand rupees. It is further alleged that they fired upon the informant's nephew and threw bombs at the place of occurrence.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not
Patna High Court CR. MISC. No.38117 of 2024(2) dt.17-05-2024 2/2 named in the FIR and his name transpired during investigation. Petitioner has got no criminal antecedent and languishing in judicial custody since 6.3.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Kishanganj in connection with Kochadhaman P.S. Case No. 187 of 2018.
