2. The petitioner seeks bail in connection with Silao P.S. Case No. 368 of 2023 dated 30.12.2023 registered for the offences punishable under Sections 341, 324, 307 and 504 of the I.P.C.
3. As per the prosecution case, on 30.12.2023 at about 5.00 P.M., the informant was warming by fire in front of the house of Munna Devi and Munna Devi was also warming heat there. In the meantime, Golu Manjhi (petitioner) came from his house and started abusing to Munna Devi and cut her neck with knife and hasuli. When the informant came to rescue her, he was also assaulted with Hasuli, as a result of which, he sustained
Patna High Court CR. MISC. No.36432 of 2024(3) dt.03-07-2024 2/3 injury on his right hand.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner, Munna Devi and the informant are the agnates and there is land dispute between them. It is further submitted that at the relevant time of alleged offence, a hot talk was made between them. The petitioner had no intention to cause death to the informant and Munna Devi. Munna Devi was treated by the doctor and after treatment, she was released and now she is very well. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 31.12.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Silao P.S. Case No. 368 of 2023 with further condition:- (I) The petitioner is directed to remain
Patna High Court CR. MISC. No.36432 of 2024(3) dt.03-07-2024 3/3 physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
