The petitioners seek bail in a case registered for the offence punishable under Sections 147, 148, 149, 342, 323, 427, 354-B, 307 & 302 of the Indian Penal Code.

300-400 unnamed miscreants are said to have intruded into the house of the informant and drove out the family members of the informant, assaulted them inflicting grievous injury to the informant and his nephew, namely, Ajay Kumar Malakar @ Sanni. They tore the attire of the daughter of the informant in order to outrage her modesty and damaged his

It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. The petitioners have committed no offence and have no concern with the aforesaid occurrence. They have been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioners are not specific rather general and omnibus in nature. There is case and counter case between the parties. Coaccused, namely, Raj Kumar Chaudhary and others, Devendra Paswan and others and Arya Kumar @ Manish Pasi have been enlarged on bail by a co-ordinate Bench of this court and this Court also vide order dated 16.03.2019, 01.04.2019 and 16.04.2019 passed in Cr. Misc. Nos.21348 of 2019, 23827 of 2019 and 27933 of 2019 respectively. The petitioner nos.1, 2 & 4 have been languishing in custody since 15.02.2019 while petitioner no.3 has been languishing in custody since 23.03.2019.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
