Informant, Pramila Devi along with her son was sleeping over Chowki while deceased Satrudhan, her husband was sleeping on floor, she awaken hearing trampling sound and then found neck of her husband having been slitted and was dead. She had further shown suspicion against her Debar, Hardeo Singh and his sons who were annoyed over having the land sold by deceased in favour of petitioner, Narayan Singh. After going through the case diary, it is apparent that police instead of trailing Hardeo Singh and his son used them as witness who shown suspicion against the petitioner and for that gave an explanation that some of the consideration money was still due and for that there was repeated demands however, neither been corroborated by the informant nor by her son on this very score. Furthermore, none is an eye witness to occurrence. Petitioner happens to be under custody since
Patna High Court Cr.Misc. No.50107 of 2014 (4) dt.06-04-2015 26.08.2014 and on account thereof, petitioner Ram Narayan Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No.334 of 2014.
