JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. According to prosecution case, altogether 6 persons opened fire on the deceased, Bipin Yadav aiming at different parts of his body. So far as petitioner is concerned; it is stated that he, too, fired on deceased, Bipin Yadav but the first information report does not disclose as to which part of body of the deceased, Bipin Yadav was hit by firing of the petitioner. Moreover, the postmortem report of deceased, Bipin Yadav reveals that only three fire-arm injuries were found on his person. So far as deceased, Pintoo Yadav and Randhir Yadav are concerned; there is
Patna High Court Cr.Misc. No.2154 of 2015 (7) dt.28-07-2015 2/2 no allegation against this petitioner that he opened fire on the deceased, Pintoo Yadav and Randhir Yadav. Considering the facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Munger Muffasil P.S. Case No. 96 of 2011 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Munger.
