The petitioners, who are brothers amongst themselves, seek bail in anticipation of their arrest in connection with Ara Town P. S. Case No. 343 of 2020, corresponding to Excise Case No. 1045 of 2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

197.975 litres of liquor is said to have been recovered from the newly constructed house of the

Patna High Court CR. MISC. No.33004 of 2020(2) dt.03-03-2021 2/2 petitioners.

Regard being had to the nature of accusation against the petitioners, I am not inclined to release the petitioners on anticipatory bail, notwithstanding the fact that nothing has been recovered from their personal possession and that they only alleged to have run away from the place of raid.

The anticipatory bail petition stands dismissed. However, if the petitioners surrender before the court below and seek bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
