Petitioner is in jail custody since 27.1.2015 in a case registered under sections 269, 313 and 314/34 of the Indian Penal Code.

Even if it is assumed that petitioner was working as Nurse in the concerned Nursing Home, then also, it is the doctor who caused abortion to the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Baniyapur P.S.
