ANJANA MISHRA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Sahebpur Kamal P.S. Case No.136 of 2013 for allegedly having committed the offence under Sections 147, 148, 149, 302 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the present case has been lodged in retaliation to the earlier case filed by the father of this petitioner in which the sister of the petitioner had died. Learned counsel further submits that the deceased was one of the persons, who had participated in the occurrence leading to the death of the sister of this petitioner

Patna High Court Cr.Misc. No.7329 of 2015 (6) dt.08-09-2015 2/2 and while accused persons of other case were running away, they were caught by the villagers and other members of the group, who named that unlawful elements had beaten Ram Briksha Yadav @ Ghotal Yadav to death. Learned counsel submits that other co- accused persons similarly situated have been extended the privilege of anticipatory bail by a Bench of this Court in Cr.Misc. No.52068 of 2014, vide order dated 6.1.2015.

Taking into consideration all facts and circumstances and further because the petitioner has no criminal antecedents, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Dev Priya, Judicial Magistrate, 1st Class, Begusarai, in connection with Sahebpur Kamal P.S. Case No.136 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
