The name of petitioner came in confessional statement of co-accused Hari Narayan Sah from whose house alleged stolen articles were recovered but admittedly, the co-accused Hari Narayan Sah was caught by the police at the time of raid and he disclosed the name of some persons but did not disclose the name of petitioner.
