JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This application, for grant of anticipatory bail, arises out of Chiraiya P.S. Case No. 100/19, disclosing offences under Sections 304[B], 201, 120[B]/34 of the Indian Penal Code.

Petitioners happen to be father in law and mother in law and allegation against them and other is of causing death of the deceased in connection with demand of dowry and also of disposing of the dead body of the deceased.

Submission of learned counsel for the petitioners is that they are father in law and mother in law of the deceased and no specific allegation has been attributed to them and the dead body of the deceased was cremated in presence of informant,

Heard learned A.P.P. as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioners, however, they could not point out any specific allegation against these petitioners.

Having heard the parties, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chiraiya P.S. Case No. 100/19, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
