====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 02-09-2025 Heard learned counsel for the petitioners and learned APP for the State as well as learned counsel for the informant.

2. In the present case, the petitioners seek bail in connection with Katra P.S. Case No. 219 of 2024 registered for the alleged offences under Sections 80 and 3(5) of the BNS.

3. As per prosecution case, daughter-in-law of the petitioners died in her matrimonial home within 8 months of her marriage. Further allegation is that there has been dowry demand which could not be fulfilled by the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Petitioners are the parents-in-law of the deceased. Petitioners

Patna High Court CR. MISC. No.32577 of 2025(4) dt.02-09-2025 2/3 have no concern with the family affairs of the deceased and they never demanded any dowry and never tortured her. Learned counsel further submits that petitioners were not present even at the place of occurrence at the time of death of the deceased. Coaccused son of the petitioners was having good relationship with the deceased and they were living happy conjugal life. In the postmortem report no opinion has been given regarding cause of death but the viscera has been preserved. Co-accused son of the petitioners is also in custody. Petitioners are in custody since 21.12.2024 and charge-sheet has been submitted. Petitioners are having clean antecedent.

5. Learned APP as well as learned counsel appearing on behalf of the informant vehemently oppose the submission made on behalf of the petitioners. Learned counsel for the informant submits that daughter of the informant died within 8 months of her marriage and it is for the petitioners to explain how the death occurred. Learned counsel further submits that the victim lady was taken to her matrimonial home just 4 days prior to the occurrence.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that petitioners are stated to be the parents-in-law and further considering the vague nature of allegation against the petitioners and also considering the period of custody of the petitioners

Patna High Court CR. MISC. No.32577 of 2025(4) dt.02-09-2025 3/3 coupled with their clean antecedent and submission of chargesheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Court No.-7, J.M.F.C., East Muzaffarpur/concerned court in connection with Katra P.S. Case No. 219 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bonds of the petitioners will be liable to be cancelled by the court concerned.
