The petitioner seeks bail in Rajaun P.S. Case No. 214 of 2014 registered for the offence punishable under Sections 341, 323, 324, 307,504,506 and 337/34 of the Indian Penal Code. The petitioner is said to have assaulted Bishnudeo Yadav, the father of the informant, with iron rod causing injury on his head, while the informant and others were protesting to remove the brick soiling from the land which was being used for Rasta. It is submitted that during investigation, it has been come to light that there has been occurrence of brick batting from both sides with regard to the land in dispute which was being used as Rasta by the informant and others.

Learned counsel for the State submitted that even after the occurrence, petitioner has been made an accused and Rajaun

Patna High Court Cr.Misc. No.15157 of 2015 (3) dt.02-06-2015 2/2 P.S.Case No. 08 of 2015 for the offence under sections 25(1-B) A/26 of the Arms Act was instituted and after due investigation charge sheet has been submitted in the case.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka Court concerned after framing of charge in Rajaun P.S. Case No.214 of 2014 with the following conditions : 1.

One of the bailors will be the close relative of the petitioner.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
